Terms and Conditions
The Author certifies that they are at least 18 years of age and the author of the work being submitted to The Absent Willow Review. This work has not been published previously online or in print. The Author represents and warrants that he/she is the sole author(s) of the Work, that the Work is original, and that no one has reserved the rights granted in this agreement. The Author also represents, to the best of his/her knowledge, that the Work does not contain any libelous material, and is not in violation of any rights of privacy or any other rights of third persons, and does not violate any existing common law or statutory copyrights, and has not been published before in any form.
The Author agrees to hold the Publisher harmless against any judgment finally sustained that the Work contains libel, plagiarism and/or invasion of privacy.
With this submission, the Author is granting The Absent Willow Review the following rights:
- Exclusive First Worldwide Electronic Rights or First English Rights to publish and distribute. The Author’s work may not appear in another publication for 6 months following its acceptance by The Absent Willow Review without written consent from the editor. If the Author’s work should appear in another publication after that time has elapsed, it will be noted that it first appeared in The Absent Willow Review. In the event that the Work is not published in The Absent Willow Review’s online e-zine within 6 months of the date of its acceptance, these rights revert to the Author, and the Author has the right to sell or arrange for publication of the Work in any manner.
- Non-Exclusive First Worldwide Electronic Rights to publish and distribute the work after the 6 month period. The Author agrees that The Absent Willow Review may archive this work after its initial publication on its website.
- First Anthology Rights to publish and distribute. The Author agrees that The Absent Willow Review may consider the Author’s work for a print/electronic publication in an annual or semi-annual anthology in the future. For the granting of First Anthology Rights, if included within the anthology of that year, the following will apply:
(3a) For inclusion in the Anthology, fifty per cent (50%) of the Anthology’s earnings will be distributed to all contributing Authors on a pro rata basis in terms of the published word count of the Work and only during the Royalty Period specified below. The distribution of royalties to the Authors will take place no more than twice per year on or around the 30th day of June and the 30th day of December, assuming that royalties have been paid out by the publisher in that time frame.
(3b) In the event of sale of the anthology to a mass market publisher for reprint publication, the Author will receive a 50/50 pro rate share of the anthology’s earnings, to include all income from trade, book club, reprint, translation, and foreign sales of the anthology, or any subsidiary rights sales income received by the Anthologist for this anthology within the royalty period. The royalty period will continue for a length of two (2) years from the date of the original publication of the Anthology. After this term, any subsequent royalties will be paid to the Anthologist alone.
(3c) If the work is not included in an anthology published by Absent Willow Publishing, LLC for a period of eighteen (18) months after its first acceptance by The Absent Willow Review, First Anthology Rights will revert back to the Author.
(3d) The Author agrees to inform the Anthologist of his/her current address. If this address should change, and the Author does not notify the Anthologist before the next payment is due, the Anthologist is not obligated to locate the Author for purposes of payment of royalties. If the Author does not notify the Anthologist of any change of address within one year of said change, the Author forfeits future royalties to the Anthologist at the Anthologist discretion. The Anthologist will make reasonable effort to locate the Author before enforcing this forfeiture of royalties.
The above rights include the right to make technical modifications to the Work in order to display it in the agreed upon media and formats. Such changes include, without limitation: Grammar, syntax, spelling and/or punctuation corrections; and Modification for the purpose of improving the overall quality of the Work.
Copyright remains with the Author at all times. The Author retains all rights not granted to the Publisher within this agreement.
Editor’s Note: What this all boils down to is that we are asking for the rights to place the story on the web and /or in PDF form, along the rights to print this story in our annual anthology and distribute it in the English language around the world. Publication does not solidify a work’s inclusion in the anthology for that year. Works to be included will be decided upon by the staff of The Absent Willow Review and sometimes by reader opinions. For example: If your work is published in 2009 it will be considered for any “Best of 2009” anthologies published for that year. If, after 18 months, your work does not appear in an anthology the First Anthology rights revert back to you. The exclusive period also expires in 6 months and you are free to sell your work elsewhere.
Artwork:
The Absent Willow Review does solicit the use of artwork. This is done by request and the artist is asked for their permission for the AWR to use their graphic(s) on our site. The use of this artwork is relegated to the “Artwork” page and may also be used to enhance a story published on the site. Any other uses accompany a specific contract between the artist and Absent Willow Publishing, LLC.
Editor’s Choice Award:
On a bi-monthly basis one author will be chosen by the editors to receive a cash prize of $50 for work published during the contest period. Winners will be given the choice of receiving the $50 contest proceeds via check or PayPal.
